By giving your consent for us to share your photo(s) featuring our product(s), you are agreeing to our Terms and Conditions. This gives Philip Kingsley Products Ltd permission to share your photo on any Philip Kingsley Products Ltd owned social media platforms, website and other marketing channels. 

From time to time, Philip Kingsley Products Ltd marketing department, along with any of our authorised service providers, select content from third party platforms (“user-generated content”) to use in the promotion of our products through Philip Kingsley Products Ltd media and marketing. The content selected by us will be used in accordance with these terms and conditions. 

How will we contact you for consent?

Upon submitting your photo(s) at selected intervals during your treatment, we will contact you via email asking for your consent. You may receive compensation, which will be expressed in at the time of requesting consent.

If we do not receive a response within 28 days from the date we first contacted you, we will assume you do not consent for us to use your content in this way and your content will not be used in Philip Kingsley Products Ltd media and marketing.

What am I agreeing to?

By consenting to our terms and conditions, you acknowledge that your content may appear on Philip Kingsley Products Ltd media and marketing. You retain the legal ownership of any photo you give your consent for Philip Kingsley Products Ltd to share, but you do give permission for Philip Kingsley Products Ltd to use the photo on Philip Kingsley Products Ltd’s webpages and in Philip Kingsley Products Ltd advertising, marketing and promotional materials, without further compensation to that which was agreed at the time of consent, or prior notice using any media or distribution methods.

Philip Kingsley Products Ltd may use, edit, alter, reproduce, translate, publish, or create derivative works at our sole discretion.

You accept we may choose not to use your content or to remove your content from Philip Kingsley Products Ltd media and marketing at any time.

You also grant Philip Kingsley Products Ltd the right to use your real name, image, likeness, caption or other identifying information in connection with the use of any of your photos displayed on our webpages. We will only use personal information supplied by you for the purposes of posting your content, unless you provide your consent for us to use your personal information for any other agreed purposes. By agreeing to these Terms and Conditions, you are consenting to Philip Kingsley Products Ltd’s collection and processing of your personal data as described in Philip Kingsley Products Ltd’s Privacy Policy.

By giving your consent, you warrant and represent that (i) you own the rights to the photo or, if the photo is subject to third party rights, that you have all required licenses, rights, consents and permissions to publish the photo and grant the necessary rights, and (ii) you are over 18 years of age. To the extent permitted by law, you also agree to waive your moral rights in relation to any photos uploaded.

What happens if I have a complaint about a photo or want a photo removed?

If you believe that an uploaded photo on our webpages is inappropriate, offensive or is violating someone’s legal rights (e.g. trademark or copyright infringement) then you can report the photo by sending an email to [email protected].

Philip Kingsley Products Ltd reserve the right to remove the photos from our social media, website, Image Bank or marketing materials at any time, for any reason.

If you remove any of the content you released to us from the third party platform it was originally posted on, then it will be removed from Philip Kingsley Products Ltd media and marketing only where you and our third party platforms are linked, subject to reasonable delays for technical reasons. If your content is used by us on third party platforms which are not linked and as a result your content is not automatically removed from Philip Kingsley Products Ltd media and marketing, and you would no longer like your content to be shared on the relevant Philip Kingsley Products Ltd platforms, then please contact us via email at [email protected].

Once we have received your email requesting removal of content, we will review your request and if agreeable, we will remove your content from Philip Kingsley Products Ltd media and marketing within a reasonable timeframe.

These terms are governed by English law and any disputes in relation to them are subject to the exclusive jurisdiction of the English courts.
